These terms govern the agreement between you and Babala Özdemir (“we”) regarding your use of the Swiss Mushrooms: Look-alikes app. By installing or using the app you accept these terms. If you do not agree, please do not use the app and remove it from your device.

1. What the app does

Swiss Mushrooms: Look-alikes is a reference app about mushrooms in Switzerland for iPhone and iPad: species pages with photos and our own descriptions, feature-by-feature look-alike comparisons, a key by features (without photo recognition), a season heatmap from Swiss records (SwissFungi via GBIF), today’s cantonal collecting rules, a safety checklist, an emergency card with the emergency numbers and a private find journal with map and CSV/GPX export. All content is built into the app; it works without an internet connection (except the journal’s map view).

Not professional advice. Mushrooms can be deadly poisonous, and the app may contain errors. It is a reference and learning aid — not a mushroom identification, not a clearance to eat, and not medical or legal advice. Never identify or eat a mushroom based on the app alone; always have mushrooms you collected checked at an official mushroom inspection office before eating them. Decisions about collecting and eating, and compliance with cantonal and municipal collecting rules, are your responsibility; canton rules in the app are shown with the date they were checked and are not binding. If poisoning is suspected, call Tox Info Suisse 145 or the emergency number 144 immediately.

2. Licence

We grant you a non-exclusive, non-transferable, non-sublicensable and revocable right to use the app on devices you own or control, for private purposes, subject to these terms and the usage rules of the respective app store. All rights in the app, its content, text, images, illustrations, voices and source code remain with us or our licensors.

3. What is not permitted

Your find journal, photos, find locations and notes belong to you and stay on your device. We never receive them, claim no rights to them and can neither view nor restore them. Backups are your responsibility (device backup or export as CSV/GPX). The photos on the species pages come from third parties and are subject to the licences named in the app with each photo.

5. Price

Swiss Mushrooms is a paid app that you buy once in Apple’s App Store; the price is shown in the App Store before you buy. There are no in-app purchases, no subscription and no advertising. Family Sharing is enabled. With the same Apple ID you can download it again after reinstalling without paying again. We receive no payment instrument data. Refunds are governed by Apple’s terms and must be requested from Apple directly (reportaproblem.apple.com). Apple’s “Licensed Application End User License Agreement” applies in addition; these terms are concluded between you and us only, with Apple as a third-party beneficiary. We alone, not Apple, are responsible for the app and its content.

6. Availability and changes

We continue to develop the app and may change, add or discontinue features. We cannot guarantee uninterrupted availability; maintenance, third-party outages or force majeure may cause interruptions. If a change permanently removes a core feature you paid for, we will inform you and seek an appropriate solution.

7. Warranty and liability

The app is developed with due care and provided “as is”. We are fully liable for damage caused intentionally or by gross negligence, and for injury to life, body or health. For slight negligence we are liable only for breach of essential contractual duties, limited to foreseeable damage typical for this type of contract. Liability for lost profit, data loss or consequential damage is excluded to the extent permitted by law. Mandatory claims under product liability law and mandatory consumer protection law remain reserved.

Please back up important data yourself. We recommend not relying solely on the app where an outage would have significant consequences.

8. Data protection

The data processed by the app is described in the Privacy policy. How to delete your data is described under Delete data.

9. Termination

You may terminate this agreement at any time by deleting the app and, where applicable, removing your account. We may suspend or terminate access if you materially or repeatedly breach these terms. In that case we refund unused prepaid amounts pro rata, unless the suspension results from a serious violation.

10. Governing law and jurisdiction

Swiss law applies, excluding the CISG and conflict-of-law rules. Place of jurisdiction is — to the extent legally permissible — our registered seat in 4414 Füllinsdorf. Mandatory places of jurisdiction for consumers at their domicile remain reserved.

11. Final provisions

If a provision of these terms is invalid, the remaining provisions stay in force. We may amend these terms when the app, the legal framework or store requirements change; material changes are announced in the app. Continued use after a change constitutes acceptance of the new version.
